General Terms & Conditions and Buyer Information
Fundamental Provisions
These general terms and conditions govern all agreements entered into through the www.indospice.de online shop. Any conflicting or supplementary terms introduced by the buyer are expressly excluded unless we have given prior written consent.
Within this document, a 'consumer' is defined as any individual who enters into a transaction for purposes that fall predominantly outside their trade, business, or professional activity. A 'trader' refers to any individual, company, or legally recognised partnership that acts in the course of their commercial or self-employed professional activity.
Formation of the Agreement
This agreement pertains to the sale of products. By listing an item on our website with its corresponding details and pricing, we are making a binding proposal to enter into a sales agreement on those specified terms.
The ordering process uses our online basket system. Items you wish to buy are added to your basket. During checkout, you will be asked to provide your personal information, delivery address, and preferred payment method. A summary page will then display all your order details for review.
If you choose an instant payment provider (such as PayPal, Amazon Pay, Sofort, or similar), you may be directed to their platform to complete payment. You are free to review and modify your order information at any stage before finalising it. By pressing the final order button, you confirm your acceptance of the offer, and a binding purchase agreement is established.
All orders and order confirmations are handled electronically via email. Please make sure the email address you provide is accurate and that incoming messages are not intercepted by spam or junk mail filters.
Right of Retention & Ownership Reservation
You may only exercise a right of retention where the underlying claims originate from the same contractual relationship. All delivered products remain our property until the purchase price has been settled in full.
Warranty Coverage
Your statutory warranty rights remain fully applicable. We kindly ask consumers to inspect all delivered items promptly for completeness and any visible damage, and to report any issues to both us and the delivery carrier as soon as possible. However, not doing so will not limit or affect your statutory warranty entitlements in any way.
Governing Law & Place of Jurisdiction
The laws of the Federal Republic of Germany shall apply to all matters arising from this agreement. This choice of law does not restrict consumers from relying on the mandatory consumer protection provisions of their country of habitual residence.
For customers acting in a commercial capacity, the exclusive place of jurisdiction and performance for all disputes is our registered business location. The same applies where a customer has no general place of jurisdiction within Germany or the European Union. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

This agreement is conducted in English. We do not retain a copy of the finalised agreement text on our end. Prior to submitting your order, you may print or electronically save all relevant contract information using your browser's built-in functions. Once your order has been placed, we will send you the order details, the legally required information for distance selling contracts, and these general terms and conditions by email.

Pricing & Payment Terms
Every price displayed on our website is inclusive of statutory VAT and all applicable surcharges. Shipping fees apply separately unless the listing specifically states that delivery is free of charge. The available payment options are displayed on our website. Unless a different arrangement is agreed upon, all payments are due at the time of purchase.
Shipping & Delivery Terms
Information regarding delivery options, estimated timeframes, and any applicable shipping restrictions can be found on our website or within the individual product offer. For consumer orders, the risk of loss or damage transfers to you at the point of delivery. Should you arrange your own shipping through a carrier not designated by us, the risk transfers as soon as the goods are handed over to that carrier.
Warranty Provisions
Our obligations regarding product defects are governed by the warranty clauses set out in these general terms and conditions.
Age Restrictions on Alcohol Sales
Alcoholic beverages are not available for purchase by or supply to anyone under the age of 16. Beer and wine products may only be purchased by individuals aged 16 or older. Spirits, liqueurs, aperitifs, and mixed alcoholic drinks (including alcopops) are restricted to buyers aged 18 and above.
